Ex-gov Ynares’ indictment upheld in fertilizer scam
The Sandiganbayan 3rd Division has turned down the pleading of former Rizal governor Casimiro Ynares Jr. to dismiss the two graft charges against him over his alleged involvement in the purchase of overpriced fertilizers.
Contrary to his claims that the Office of the Ombudsman took too long to file the charges, the anti-graft court ruled there was no inordinate delay in the filing.
“To reiterate, the delay which attended the fact-finding investigation and preliminary investigation of the herein accused-movants should not be a cause for an unfettered abdication by the Court of its duty to try and determine the controversy in these criminal cases,” the court stated in its resolution.
“The protection under the right to a speedy disposition of cases should not operate to deprive the government of its inherent prerogative In prosecuting criminal cases,” it said.
Records showed Ynares awarded the contract to Feshan Philippines in November 2004 and March 2005 for the purchase of ply of 2,455 bottles of organic fertilizers at the price of P1,500 each.
However, the Ombudsman discovered the purchase did not undergo the required public bidding and that each of the contracts were overpriced by P3.23 million.
